Welcome to Military Realty! These Terms of Use constitute a legally binding agreement between you (referred to as “you” or “User”) and Military Realty, a Nevada sole proprietorship (referred to as “Military Realty” or “the Company”).

Acceptance of Terms

Before using our website, www.Military-Realty.com (the “Site”), or any mobile applications provided by us (the “Apps”), please carefully review these Terms of Use. Together, the Site and Apps form the “Platform,” encompassing text, graphics, photos, sounds, data, and other materials (collectively, the “Information”) owned or licensed by Military Realty.

By accessing and using the Platform, you affirm that:

• You understand and agree to these Terms of Use, creating a binding agreement.
• You will comply with these Terms of Use and any updates or additional policies issued by Military Realty.
• You will adhere to all applicable federal, state, and local laws governing your use of the Platform.

If you do not agree with any part of these terms, you are prohibited from using the Platform.

Eligibility and Representation

By accessing the Site, you represent and warrant that:

• You are 18 years of age or older.
• You are not currently restricted from using the Platform.
• You are not engaged in any business directly competitive with Military Realty.
• You have the authority to enter into these Terms of Use without violating any other agreements.
• You will not infringe upon Military Realty’s intellectual property rights.
• You will bear all costs for necessary equipment, software, and internet access.

Privacy Policy

Any personal data you provide or that Military Realty collects about you is governed by our Privacy Policy. By using the Platform, you acknowledge and accept the terms of our Privacy Policy, which is incorporated herein by reference.

Mission and Services

Military Realty is committed to supporting active-duty service members, veterans, and their families throughout the home buying and selling process. Our mission is fulfilled through several key initiatives:

• Platform Access: We connect service members and clients with local real estate agents who understand the unique challenges and needs of military personnel.
• Cash Rewards: For service members, Military Realty offers cash rewards upon the completion of a home purchase or sale through our platform.
• Charitable Donations: When working with non-service member clients, Military Realty donates an equivalent cash reward to veteran-focused charitable organizations, reinforcing our commitment to the military community (collectively, the “Military Realty Program”).
• Educational Resources: We inform the military community about best practices in the home buying and selling process, empowering them with knowledge to make informed decisions.
• Discounted Home Services: Through partnerships with affiliated providers, Military Realty offers discounts on common home services, enhancing affordability and convenience for our users.
• Free Consultations: We offer complimentary consultations to individuals interested in the home buying or selling process, providing expert guidance and answering questions without obligation.

Military Realty collaborates with real estate agents and brokerages nationwide who share our mission to give back to those who have served. We also serve clients who are not service members (referred to as “Clients”), directing funds that would be a cash reward to veteran-focused charities selected by Military Realty.

Closing Bonus Terms

Military Realty connects Agents, Service Members, and Clients through its Platform without charge. Agents utilizing our Platform agree to pay a Referral Fee to Military Realty and allocate a Closing Bonus to eligible Service Members. The Closing Bonus is calculated based on the purchase price of the home.

In addition to the Closing Bonus provided to Service Members, Military Realty donates an extra 10% of the Closing Bonus amount to a charity selected by Military Realty.  (Ex: If, Closing Bonus amount is $2,000 the donation amount is $200) This charitable contribution is NOT taken out of the Closing Bonus amount disbursed to Service Members at the time of closing.

Where local or federal regulations restrict the provision of a Closing Bonus, alternative arrangements compliant with all applicable laws will be offered to Service Members. These arrangements will be communicated clearly to ensure compliance.

Service Members must sign a Closing Bonus Agreement with the Agent to qualify for the Closing Bonus. Eligibility criteria, including verification of military status, may vary by state. For new loans, the distribution of the Closing Bonus is subject to lender approval.

Platform Usage and Limitations

The availability of Services via the Platform may vary by location and demand, with no guaranteed availability. Users must use the Platform in accordance with these Terms of Use and applicable laws. Military Realty reserves the right to modify or terminate the Platform or any part thereof at any time without notice.

Community Guidelines

Users must adhere to our community guidelines when using the Platform, including but not limited to respecting others’ privacy, refraining from abusive behavior, and complying with all applicable laws and regulations.

Agent Guidelines

Agents using the Platform must comply with our Agent Guidelines, including providing accurate information, maintaining proper licensing, and upholding ethical standards in their interactions with Clients and Service Members.

Governing Law, Jurisdiction, and Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms of Use or the use of the Platform shall be exclusively resolved in the state or federal courts located in Clark County, Nevada.

Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. Military Realty disclaims all warranties, including but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Claims

To the fullest extent permitted by applicable law, Military Realty shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Platform; (b) any conduct or content of any third party on the Platform; or (c) unauthorized access, use, or alteration of your transmissions or content.

Copyright and Trademark Notice

All content and materials on the Platform, unless otherwise indicated, are owned by Military Realty and are protected by copyright, trademark, and other intellectual property laws. Unauthorized use of any content or materials on the Platform is prohibited without the express written consent of Military Realty.

Communications

By using the Platform, you consent to receive electronic communications from Military Realty relating to your use of the Platform. These communications may include notices about your account, updates, or changes to the Platform, and other information.

Limitation of Liability and Agent Restrictions

Military Realty acts solely as a platform to connect Users with real estate agents (“Agents”) who have self-identified as military veterans. All Agents listed on our platform are listed for free, and Military Realty does not charge them for this service. By agreeing to be listed on our platform, Agents consent to waive 25% of their transaction commission to Military Realty, as well as pay the clients Closing Bonus. A portion of this commission supports the upkeep of our platform, provides the “Closing Bonus” to eligible Users, and contributes to charitable donations to military charities.

Agent Restrictions: Agents listed on our platform must comply with the following restrictions:

• Agents must be military veterans or spouses of military personnel.
• Agents must hold valid real estate licenses in their respective jurisdictions.
• Agents must adhere to ethical standards and provide accurate information to Clients and Service Members.
• Military Realty reserves the right to remove any Agent from the platform without notice for violations of these terms or for conduct detrimental to the reputation of Military Realty or its Users.

Limitation of Liability: Military Realty serves solely as an intermediary platform and does not participate in or assume liability for any actions, transactions, or communications between Users and Agents. We do not guarantee the performance, quality, or legality of the services provided by Agents listed on our platform. Users interact with Agents at their own risk, and Military Realty disclaims all liability arising from such interactions.

Indemnification: By using the Platform, you agree to indemnify and hold Military Realty harmless from any claims, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising out of or relating to your interactions with Agents or other Users on the Platform.

Termination of Agent Listings: Military Realty reserves the right to terminate or suspend the listing of any Agent on our platform at any time and for any reason without prior notice. Reasons for termination may include but are not limited to violations of these Terms of Use, ethical breaches, or conduct that compromises the integrity of our platform.

Entire Agreement

These Terms of Use constitute the entire agreement between you and Military Realty regarding your use of the Platform, superseding any prior agreements between you and Military Realty regarding the same subject matter.
